Explanation and Content:
1. See Attached Letter to President Bush and other officials mentioned above (to be distributed at the Press Conference).
2. On September 2, 1945, General Douglas MacArthur in his General Order No. 1 directed the representatives of Chiang Kai-shek (CKS) to come to Taiwan and accept the surrender of Japanese troops. The surrender date of October 25, 1945, marks the beginning of the military occupation of "Formosa and the Pescadores." But when the post-war San Francisco Peace Treaty (SFPT) came into effect on April 28, 1952, were its provisions carried out? What should have been the disposition of the "representatives of CKS" at that time? Are there historical and legal errors which need to be corrected?
3. In particular, what is the true significance of Article 4b of the SFPT:
Japan recognizes the validity of dispositions of property of Japan and Japanese nationals made by or pursuant to directives of the United States Military Government in any of the areas referred to in Articles 2 and 3.
4. We call upon the US government to respond to these important issues within two weeks. If satisfactory answers are not forthcoming, we will launch legal action in the US courts for the protection of the life, liberty, and property of the Taiwanese people based on the fundamental constitutional rights of the FOURTH and FIFTH amendments to the US Constitution, rights which apply in all areas "under the jurisdiction of the United States."
